The below templates have been added to our website for the convenience of our members.

Prior to submitting, please contact the DRC Help Desk for guidance. The DRC Trading Assistance Office will provide step-by-step procedural guidance about what to expect and when to complete which forms.

Informal:

Notice of Dispute (NOD)

This template is completed by the claimant to initiate the informal mediation process. Once a full account of the transaction, along with supporting documentation, has been prepared, please submit the signed NOD to the DRC Trading Assistance Team. In order for DRC to confirm the NOD both parties must have been members at the time of the transaction and the dispute must have occurred within the last 9 months.

Reply to Notice of Dispute (RNOD)

This form is to be completed by the respondent within 7 days of receiving the Confirmation of Receipt of the Notice of Dispute (CNOD). This form should have already been provided to you with the CNOD. If you are unsure if this is the proper document, please contact the DRC Help Desk.

Standard Reply Template (SRT)

Once the claimant and respondent have provided their NOD and RNOD, respectively, DRC may still require additional information. If you are asked to share your comments or supporting documentation, this document should be used for your response.

Formal:

Statement of Claim (SOC)

Submitting a Statement of Claim (SOC) commences the arbitration process. Please contact the DRC Help Desk prior to sending this form. If you have not made DRC aware of your intentions to file and you have not yet received an invoice, your SOC may not be confirmed.

Statement of Defense to Statement of Claim (SODOC)

This form is to be submitted by the respondent in response to a SOC. If you have any questions about how or when to submit a Statement of Defense to Statement of Claim (SODSOC), please contact the DRC Help Desk.

Reply to Statement of Defense (RSOD)

To be completed by the claimant, this form is an opportunity to respond to the respondent’s SODSOC. Unlike the SOC and the SODSOC, this form is not mandatory to complete.

Counterclaim (CC)

A counterclaim should not be submitted without first contacting the DRC Trading Assistance Office. If you have not made DRC aware of your intentions to file and you have not received an invoice, your counterclaim may not be confirmed. Please contact the DRC Help Desk.

Article 1 (b)(vii) of the Dispute Resolution Rules defines counterclaim as:

…a claim by a respondent arising out of the transaction or occurrence that is the subject matter of the Claim and that is in excess of the amount being claimed by the claimant. Subject to Article 4, a Counterclaim is to be brought by way of a Counterclaim provided that the respondent previously gave notice of the Counterclaim during the informal consultation process. Claims by a respondent arising out of the transaction or occurrence that is the subject matter of the Claim that are less than the amount being claimed by the claimant are to be asserted as a defence only in the Statement of Defence. Claims by a respondent arising out of the transaction or occurrence that is the subject matter of the Claim that are out of time pursuant to Article 4 may be asserted as a defence to the Claim in the Statement of Defence but no amounts in excess of the Claim shall be recoverable.
