Definitions

Agent

Any firm contracted by a grower or growers to merchandise, on behalf of the grower(s), multiple shipments of fruits or vegetables. An Agent generally receives payment from its customers, prepares a detailed accounting of those sales and deducts from it a commission and expenses, remitting the balance to the grower(s).

Grower’s Agent

Any firm contracted by a grower or growers to merchandise, on behalf of the grower(s), multiple shipments of fruits or vegetables. An Agent generally receives payment from its customers, prepares a detailed accounting of those sales and deducts from it a commission and expenses, remitting the balance to the grower(s).

Broker

Any person engaged in the business of negotiating sales and purchases of produce for or on behalf of the vendor or purchaser, respectively. A broker does not take title of the product. (Note: For the purposes of the SFCR, an intermediary taking title of the produce is a Dealer)

Dealer

Any person or entity engaged in the business of buying or selling fresh fruits and or vegetables.

Persons

A person can be an individual or an organization – including an association, company and corporation; includes other recognized legal entities such as LLC, partnerships, etc.

Produce

Fresh fruits and/or vegetables.

Single day

Within a single day.

Previous 12 months

The previous 12 months from the day an activity is conducted that is otherwise prohibited in section 122(2)(b). (i.e.: the date of last transaction)

I negotiate the sale on another person’s behalf fresh fruits or vegetables that are to be exported or to be sent or conveyed from one province to another.

Q & A

Customs Broker

A customs broker is not subject to the SFCR because a customs broker does not purchase or sell produce and is a service provider facilitating the international cross-border movement of produce.
